    WASHINGTON, / RankWire.AI / – On Monday, both ethics watchdogs and legal specialists urged Congress to embed strict anti-corruption measures into upcoming cryptocurrency laws, warning that lawmakers must address the crypto conflict of interest loopholes or consider abandoning the CLARITY Act altogether. In a joint statement, the bipartisan advocacy group Democracy Defenders Action and the civil society organization Transparency International U.S. criticized the ethics provisions within the Digital Asset Market Clarity Act. They contended that the current legal framework does not adequately safeguard the integrity of the digital asset market, American consumers, or the national economy from self-dealing by officials.

    Legal authorities from both oversight groups pointed out that the ethics language in the Senate draft was narrowly tailored and included significant statutory exemptions. The advocacy organizations noted that the draft effectively grandfathered in existing cryptocurrency holdings and financial arrangements while lacking robust enforcement mechanisms. They argued that the legislative language essentially shields pre-existing commercial ventures from federal oversight. To achieve meaningful reform, the watchdogs called for a comprehensive ban that prohibits all covered officials from holding direct financial interests, engaging in digital asset trading, or benefitting from existing licensing and profit-sharing agreements.

    The coalition outlined essential policy measures needed to prevent public officials from exploiting federal oversight of digital assets for personal financial gain. The proposed ethics standards stipulate that officials and their immediate family members—including spouses and dependent children—must divest from all digital asset holdings outside of diversified registered investment funds. Additionally, the groups emphasized the importance of strict rules to prevent adult children of officials from leveraging familial or positional connections to promote commercial crypto ventures. They also stressed that full financial disclosure must be required for all digital asset transactions, including acquisitions, sales, and transfers, regardless of any compensation involved.

    Ethics Watchdogs Push for Complete Ban on Official Cryptocurrency Holdings

    Regarding enforcement, the oversight organizations stated that ethics rules need an independent administrative authority to ensure their effectiveness beyond any single presidential term. They urged Congress to empower the Attorney General with investigatory authority under an extended statute of limitations, and to allow private entities and state attorneys general to pursue legal remedies against misconduct. Virginia Canter, the chief counsel and director of ethics and anti-corruption at Democracy Defenders Action, warned that ethics legislation without independent enforcement is essentially a license for corruption. She emphasized that Congress must commit to banning officials and their families from holding digital asset interests altogether.

    Policy analysts and economic experts observed that the broader debate around the CLARITY Act centers on defining regulatory jurisdiction over the digital asset industry. The legislation aims to clarify regulatory roles between federal market authorities and shift away from enforcement-heavy strategies. Nonetheless, ethics advocates highlighted that public trust depends on strict boundaries separating regulatory authority from private financial interests. Scott Greytak, deputy executive director at Transparency International U.S., noted that the public expects officials to choose whether to regulate an industry or profit from it, stressing that lawmakers must close crypto conflict of interest loopholes or scrap the CLARITY Act to preserve government integrity.

    As the Senate reviews the bill draft, congressional leaders face increasing pressure from ethics groups to settle the dispute over conflict-of-interest protections. Oversight experts warn that allowing exceptions for pre-existing commercial ties sets a risky precedent for federal ethics enforcement in emerging financial sectors. Representatives from both advocacy groups reiterated that removing these exemptions is the minimum needed to restore public confidence in federal oversight of markets.

    The future of the CLARITY Act hinges on whether committee negotiators incorporate enforceable ethics requirements before the bill reaches a final vote. Congressional aides indicated that bipartisan discussions over potential amendments to enforcement provisions are ongoing. Ethics advocates cautioned that passing the legislation without comprehensive prohibitions on conflicts of interest would undermine regulatory credibility and perpetuate ethical conflicts across government institutions.
